    Good day. I got into this forum to get some advice. Im currently separated, but our marriage is not annulled yet. I have a British immigrant boyfriend, a US Navy, he's a filipino, a US citizen. I don't exactly know what is his residence status there. But he wish to bring me there. Im thinking of applying for work visa, I am a CPA here in Phils. but according to him it would take long find an employer. He's suggesting get a partner visa..use my maiden name instead, but im not comfortable with that. What is the fastest way get there? Please help..I absolutely have no single idea with the process. Thanks so much in advance

    Your boyfriend is a Filipino-American and a former US serviceman currently living in the UK, visa status unknown but possibly a visitor. As he is a non-EEA citizen, I very much doubt that he can sponsor you for any kind of visa except, possibly, a tourist one. Additionally and unfortunately you will find more than a little difficult in obtaining a work visa. There are visas available for certain professions where there is a current skills shortage - and these are published on the Home Office's web pages - but I very much doubt that list includes accountants. I believe your only possible option would be a tourist visa but it can not be converted to one granting residential (or immigrant) status and you will have to prove compelling reasons to return to the Philippines at the end of your stay.

    Hi Sir Markham, iv just asked him, he is a US and European citizen and he is qualified to sponsor. My problem is I may not qualify for partner visa, cause I still have my married name in my passport. If not, only tourist visa is possible? some suggests I get a new passport using my maiden name. but im not comfortable with that.

    Because he is a non-EEA citizens, I doubt he can sponsor your visa of any type, except possibly a tourist. In addition, unfortunately, you will find more than a little difficult to obtain work visas in.

    hello there and welcome.

    If he is a European citizen, which other nationality (EU) does he have?

    I think it is best to wait it out until you get your marriage annulled and will be able to use your maiden name again (with a new passport), then apply for a partnership visa (if that's what you want to do). the ECO would do background checks and if they discover that you are still married (legally) in the Philippines and is applying for a partnership visa, then it is fraudulent in nature, especially if you use a passport under your maiden name and declare that you are single.

    anyway, as one of the requirements for partnership or spouse visa, you would be required to submit the MC or if applying for fiancee visa, the CENOMAR.

    Marca, I'm afraid you cannot apply for a new passport as single status. The new passport system nowadays are electronically readable. Any changes you make will be recorded fraud unless you have a supporting documents to go with it like annulment papers which entitle you to use your single name again. If you try they will find out that you have another passport in a different name and this can cause you problem with DFA. There is no way you can do any short cut on this and I doubt he can sponsor you if you are not an immediate relatives. The best thing you can do is to file an annulment but this may take between 1 year to 2 years maximum depends on your lawyer's performance.
