Now What?

    Hi Guys,

    Well, we did it - I went back to the Philippines in December and married Melody.

    Of course now there is an obstacle course of paperwork to go through. Melody has received the first (Barangay) version of the wedding certificate and has managed to get the first three forms of ID changed to her new surname. Still waiting for the certificate to arrive from Manila, so the ID which she will need to obtain her passport is still in the pipeline.

    Once she has her passport, naturally we want her to be able to travel to Spain to live here with me. I understand that what I need to get, (or what she needs to get) is something called a reagrupacion familiar permit to allow her to move to the EU to live with her husband - me.

    Has anyone gone through the process themselves, and if so, can you give me any advice - Do's and Don'ts etc.

    The other point is regarding the McCarthy case last year. UKBA lost a case in which they were trying to prevent a non-EU spouse from entering the country on the premise that English law trumped EU law. Anyone have any updates on this because it would be nice to be able to show Melody my mother country. (she tells me it's cold when the temperature dips below 25 degrees, so a bit of Derbyshire chill might put things in perspective). I understand that the British Government wants to appeal against that decision (that an EU residence permit holder has the right of entry into the UK without further need for visas, but I haven't heard anything more.

    There is a chap who went the Spanish route. But he only occassionally pops his head around the door. You could PM him but I cant remember his user name.

    Its now true that a "visa national" with the five year European Family member residence card no longer needs a family permit to enter the UK with their EU spouse however if your a Brit then you will need to evidence your established in the host country as a long term resident or that you have been working in some capacity for longer than 3 months (general statement)
