Retospective Cenomar for German family reunion visa?

I'm just wondering if anyone has any knowledge on this.

Can you get a retrospective Cenomar to show that you were not married about 7 years ago? Or are there any other ways of showing this?

The situation is that my sister-in-law is looking for a Family Reunion Visa to bring her daughter to Germany. Her husband is German, but her daughter was born out of wedlock before they met.

They have already failed once because the documentation was not good enough.

She needs to provide proof of custody. I understand that there is something called the "Filipino Family Code", which grants full custody to the mother if the parents are not married, as is the case.

The first application took over a year to process, just to be unsuccessful, and one possibility is that she didn't include any proof. I thought maybe an old Cenomar and a notarised copy of the Filipino Family Code, plus an explaining letter, might do the job.

But can you get any form of evidence of not being married 7 years ago if you are now married? And would this suffice as proof of custody bearing in mind how things are in The Philippines?

This is the text of the Family Code :

What about the birth certificate will it not show the marital status of the parents?

There was a bit of an issue with the birth certificate (which I won't go into) and they need to sort that out too. It might do. I'm just thinking things myself a bit.

Based on being unsuccessful once, I reckon they should do a "kitchen sink" application. That's what we did with the fiancé visa after failing first time. Get as much evidence as possible.

    Thanks for the link.

I've just asked the missus and she believes that it is possible to get back-dated certificates but she thinks there is a time limit of about two years. She suggests your sister-in-law goes personally to a PSA office and makes her case.

Regarding birth certificates, I am named on both my sons' but there is no specific wording that their mother was married to me at the time of birth. I guess this could be inferred by our surnames being the same.

    I'll suggest that, thanks.
