Hi JohnAsh, thank you for info. It is good to know that this option is available and we can start sorting out our finances. My husband has to finish his contract too. In the meantime, we have to keep on looking for available options as my son's school offer is for January 2015.
OK. Do check the UKVI website for the fine detail. https://www.gov.uk/government/uploa...337420/Annex_FM_1_7_Financial_Requirement.pdf
Here is more up-to-date information on Surinder Singh route. Remember that it is the European Courts who have jurisdiction over this and the British Government forever tries to circumvent that court's decisions... http://www.freemovement.org.uk/surinder-singh-immigration-route/ That article is written by Colin Yeo who is a barrister from Garden Court Chambers. Garden Court Chambers is one of the very top barristers' chambers in the country on immigration law.
Here is another article written by Colin Yeo about the UK's interpretation of Surinder Singh... http://www.freemovement.org.uk/eu-to-investigate-uk-interpretation-of-surinder-singh/#more-16244
Hi again! Thank you to those who replied to my previous queries. After some research, it looks like I can't really accompany my children in UK as long as my husband is still working overseas. The Surinder Singh route won't help us because my husband can't leave the Middle East yet (2 years more I think). I want to look at the option of applying for Tier 4 ( student) visa. I have university degree from the Philippines ( will send it to NARIC for qualification comparison) and job experience in Dubai but I also want to further my education to prepare me for a career in UK once we all move back and settle there. Is this option possible? If I get accepted in one of the UK qualified education provider and can fulfill the Tier 4 financial obligation ( course fees, monthly allowance, etc.), would I have any problem applying for Tier 4 Visa? Would being married to British who is not resident of UK affect my application or having British children? Any feedback will be highly appreciated. Thanks.
That's a good idea, this way you will also be able to take the youngsters with you. I personally don't see why having a British husband who is not resident in the UK would be a problem as you would be studying in the UK and you would be self sufficient. Applying for a tier 4 visa would be considerably cheaper too, around £300. My loved one recently used NARIC for her degree comparison and you can also them to certify that you were taught in English which would make you exempt from the English test that is required. Note that you will have to contact your University and get the full course content of your degree and a letter stating that the subjects taken were taught in English. It will depend on your Uni of course how long it will take them to collate and give you the required information to satisfy NARIC, in my girlfriends case in took around a month from De La Salle. NARIC will give you a statement of comparability that will be helpful when you are finally applying for jobs in the UK. Good luck Sarah.
Thank you Timmers. I started sorting out my paperwork from the Philippines. I'm quite excited to go back to school, I hope everything turns out well.
Good to hear you are now have a positive state of mind and have found a way forward to overcome your predicament
