Schengen Visa Application refused. Now What?

    Woke up this morning to find that my wife has been refused her Schengen Visa application on the grounds that they don't a) believe the source of the Carta de Invitacion (Letter of Invitation), b) don't believe that she has sufficient resources to stay in Spain, c) don't believe that she will return to the Philippines

    They are of course correct in their assumption. Originally, I wanted to apply for a Reagrupacion Familiar visa - Family Permit, exercising my rights under EU law to have my wife live with me, but was advised that it would be quicker and easier to bring her over 'on holiday' and then flip the paperwork to get her a residency once here.

    Now, we are back to square one. We need to explore the avenue of getting the Family Permit and then pursue a Schengen visa again.

    Where do you live?

    I don't know much about Schengen visas, but certainly on a UK visa that would be bad advice. Who advised you to do that?

    Maybe Schengen is different to UK though and you can transfer?

    Hi Chris where are you both now? did your wife include your marriage certificate in the application? I dont know who gave you that advice its certainly doable that way round but it would mean buying return tickets for her to leave the Phils as a tourist

    also when you reapply if they are obstructive you can ask solvit to contact them and It may be a good idea to copy the Minsistry of Foreign Affairs in on the e-mails. They are responsable for the foreign missions. This is their e-mail address: consular@maec.es

    Hi guys, firstly, thanks for your replies and the time taken, and secondly, apologoes for not replying sooner.

    In short, we were told that all my wife needed was: To come to Spain on holiday having valid travel and health insurance, a letter of invitation and a flight ticket (return)

    The idea being to flip the paperwork once here (she has a translated, fully stamped, legalised, notarised copy of our Filipino wedding certificate)
    But the Spanish Consulate appear to have seen through this, and refused to allow her Schengen short-stay visa, claiming that they don't believe the purpose of her visit (a holiday),
    can't see that she holds sufficient funds for the holiday (we weren't asked to provide such evidence),
    felt that she could not obtain those funds lawfully (despite a letter of invitation which categorically states that her upkeep is provided for, AND holding complete travel and health insurance),
    and that they doubt that she has sufficient motive to return to the Phils
    Now I can't get a response from the people I have just shelled out 1017 euros to for her flight ticket (vayama.ie) and suppose that a refund is going to be near-impossible.

    Having looked into it in the meantime, Melody now has to provide a legalised copy of her birth certificate together with the aforementioned wedding certificate and then send them to me. I then go to the Spanish authorities and get them to recognise that she is a family member, and that I am a resident of Spain, tax-paying and all.

    I then send everything back to her, and she goes back to Manila and applies for a Family Permit which, once granted, will allow her to then apply for a Schengen visa, valid for three months. I then buy her ticket.

    Once here, we go to the Foreigners Ministry once again and Melody will receive her conditional resident card and be allowed to stay.

    If anyone has tips, advice, warnings about this, please get in touch. I don't think I could stand them turning us down again on some ridiculous assumption

    Im not really sure why they turned you down Campello or why you didnt apply for a c visa for family members If you want you can write to solvit and get there take for free and write to the ministry email above if you want to try to get them sorted in the spanish embassy. if they give you further grief you could apply to any other schengan country for entry under free movement or even turn up on there land border in morroco your missus can join you there visa free and you can duke it out at the border at mellila
