    Hi all,

I was going through the spouse application process through an immigration law firm earlier this year and after completing 6 months of employment forwarded all the necessary documents. I got a reply back saying that because I changed employer in May of this year I would now have to wait till later in the year before we can submit the visa application. I started work back in December 2016, firstly through an agency before I was offered a permanent contract in May. I was under the impression that my last 6 months of employment would count towards the £18,600 criteria. Now, before I agreed to go through the immigration law firm I did state to them if it would hinder the application with me working on a temporary contract through an agency and I was informed it would not, as long as the 6 months have been completed. Me and my wife have now decided not to go through the application process with the law firm, and will make the application ourselves. Any of you helpful folk out there been through a similar process? Also, not too sure where we stand with the 50% fee charged to us that was paid up front whether we can claim that back? Any advice would be greatly appreciated.
    Thank you.

I doubt you can claim any fees back from the law firm but you need to read the small print.

Have you your p60 april 2017 which will demonstrate your earnings December 2016 to March 2017, are you keeping your payslips from permanent employment, have yo got a contract letter stating your annual earnings, what are your earnings to date will you hit £18600 April 2017 to March 2018?

I would agree that you should wait until you have 6 months with the same employer. They will need the be sure that your employment is secure.

Hi, yes my P60 along with my payslips and a contract letter stating my annual earnings were supplied and my earnings from December 2016 to June 2017 stood at £14,000.

I agree to a point, however I changed employment in the February prior to us applying in June the same year however I had been in full-time employment with the same company for 4 years and just moved from one to another.

If the op can demonstrate that he worked for the company albeit through an agency and now has a full time position with the same company ie gone temp to perm and has a contract letter stating his annual salary is above the £18600 per year then this might suffice! I would certainly consider progressing if I was in his position but it would depend on my year end offer letter.
