UK over stay applying uk-spouse visa

    I'm new here hope anyone could give me advice or information. I entered UK under student visa I done my first studies. I enrolled and renewed my visa since then I didn't attend school. just thinking money I spent and I will spend to my studies I decided just to work and go home when my visa finished. Throughout of my stayed in UK I'm in relationship with British citizen. Until the UK border arrested me, detained then they released in the condition of I will go home. I went home, after 2 months my fiancé came in Philippines to marry me. My husband and me in the hurry to bring me back to UK.

    We both worrying do we need solicitor to arrange my documents for UK spouse visa application as my case complicated? Aside from my husband's employment details.I got everything with me that I'm paying taxes, NI, payslips and I have income in my uk bank account are these can help in my application?
    Anybody with the same situation can help me please. Thank you

    I gather it can affect your application if one has overstayed in such a manner. But if your case is strong then you may well still have a chance.

    Yes a little more complex than a normal application. We used a UK Immigration Agency who proved to be very good and professional. It cost £700 plus the visa fees. Normally using an agent is considered by many to be a waste of money as the application can easily be compiled without professional help. However if there are complications then it is a diffferent matter. Try selecting a few OISC registered Immigration agents in the UK and speak to them and try and build up a picture of them and also how they feel your case might stand. Just the cost of a few phone calls.

    There is also a member here called Micawber that pops his head through the door each day and he may well point you in the right direction.

    On finances, the UKBA focus on the sponsors finances and related documentation.

    By the way, how were you treated when detained? Did they treat you decently and where?

    In your case they will be looking at your Hubby,s income and perhaps proof that the Marriage is not one of convienience ,your previous work history is irrelevant although as you admit to visa condition breaches you will need to make sure to cross all the I,s and dot the t,s

    Be careful that you don't come up against the ten year ban. Be super-honest with every detail of your application.

    Treated us nicely and I stayed where they bringing the people they didn't allow to exit the airport. Some they bringing to proper detaining place. Can you recommend reliable solicitor for my case?

    Before I left the place where I stayed I talked to immigration officer and to in house solicitor. I can come back anytime with clear visa and with other visa category. Before I left airport I talked again to UK border in heatrow told the same. You are right the officer remind me just to be honest.

    The consensus is that the best idea is to use a good UK based agency that is OISC regulated. This is because they will be familiar with UK law and it is UK Immigration law that you will be dealing with.

    Ordinarily I might concur but in this particular instance, you need someone who is a legal professional who specialises in Immigration law, such as Gulbenkian Andonian, BHD Solicitors, Kingsley Napley and Ghersons - all of whom have web sites. Alternatively you could ask your own Solicitor to recommend such a specialist. The reason being that this application may well be refused initially and require handling at an appeal.

    My application for spouse visa will lodge here in Philippines . How it will works if we going to ask solicitor advice in UK. As I know OISC accredited can find only in UK if I'm not mistaken.

    Is your hubby in the UK? If so he would organise it from the UK. Thats what we did. All of the documents would finally end up with you in the Philippines and you would hand deliver them to the UKBA handling agent, VFS, in The Philippines.

    All of the documents that you would need from the UK eg his payslips etc etc, would be sent by your hubby by courier to you. You would add the remaining documents that you would have to add eg your passport etc etc.
