Hi friends I am a UK citizen with a rented house in Davao, I work in the UK and visit my pinay fiance when funds permit. Currently I do not meet the financial requirements for her to settle here in the UK so our long term plans are for us to live in Phil when my pension matures. In the interim we would like to apply for a UK visitors visa for her and as she is not currently working we are concerned her application may be refused. Do any members have advice for what needs to be in place before we apply for a visitor visa? Thanks in advance
What matters is to prove that you can support her stay. Also, to prove that she will come back to the Philippines when her visit visa expires. In your case, you will need to show that you have sufficient funds to support and accomodate her during stay (e.g. bank statements, pay slips, house/flat, etc.) In her case, she will need to prove that she has 'sufficient ties' in the Philippines. This is so that UKVI will be convinced that she won't be an illegal immigrant, because she will have something to come back for in the Philippines. For example: 1. Family resides in the Philippines 2. She works or studies in the Philippines. 3. She has a business. 4. She has a house/property.
Thanks for your reply, that gives us something to aim for. She has a Bank account with savings so I guess that will help along with her college ID. Hopefully I can post a sucessful outcome here on the Forum in a few weeks!
Search the forum for advice on obtaining a visit visa for your lady, there are a lot of threads on this subject.
Remember there is another way to bring your loved one to the UK if you do not meet the financial requirements, if you have the will and the means. I will let @KeithAngel explain it to you, just wait for his reply.
Thanks for your reply, I am considering alternative methods of being with my lady including temporarily moving to Belgium where I have friends. It was mentioned to me that a different set of rules apply when you reside in the EU, maybe that is the method you refer to? Your support here is much appreciated, no government will stop me finding a way to overcome this!
Sorry, forgot to mention the plan to retire in Phil was based on the requirements for a UK settlement visa, currently I am self employed and my earnings fluctuate making it difficult to comply financially. Frankly it looked impossible to me so I had more or less given up on UK residence.
You can submit two years of accounts with the application to show that on average you meet the financial requirement.
What do you do for a living Jim? If you could get work in any other European country for 3-5 months your Wife could join you for free and then return to the UK for free no earnings of nhs suppliment and only a fee of around £90
If you select Ireland as your 'jumping-off point' you - the EEA national - do not need to be employed whilst living there; you can be self-funding.
Thats true everywhere in Europe, the term is self sufficient , however the UK fails to correctly transpose that into the regulations and in effect only recognises work for SS applications
If your non EU spouse has an article 10 or 20 residents card then you can visit the UK with you (evidence of residency should be carried) You if your a Brit have right of abode but SS (against current case law) is only engaged ,in the view of the H.O. by employment
Thanks for all this info guys, been away for a few days and not had time to catch up. I was planning to see an immigration Lawyer to see what my options are and go from there. To give you a better idea of my circumstances, I had a business three years ago but a divorce ended that hence my trip to Phil and there I met my young lady and stayed for six months. I am currently working on a construction site as a plumber but only have 10 months of employment to show for immigration purposes although my income should cover the requirements eventually. The other problem as I see it is I dont have a house/flat at this time I am lodging with a friend as I still have a rented house in Phil. I did not realise there was the option to reside in Ireland and qualify as an EU citizen, maybe working there for three months is the answer? Can any member advise me on this please. Your help and advice is much appreciated.
@KeithAngel will advise you regarding the EU route, it will be ideal for you if you have some work over there.
