Urgent Help

    Well I just got an email from the Portuguessr Embassy in Jakarta seeming to say that they dont accept eea applications if the wedding was celebrated in the Phils only if i was married in a member state:frust:

    I dont believe this is right any more than the rest of the nonsence ive had but im seeing my lawer on monday and what i need is any links to european law on the right to family life and any cases that were tried and where the right was established

    It would be good to have cases like Dom where he as a italien got this visa i would also like to make contact with john car on the other site as i believe he did this to spain my lawer isnt an expert but any help i/we can give her would be much appreciated:like:

    Necessary documents for family members

    Valid identity card or passport;
    A document proving the family relationship or quality as partner, if
    this relation or quality is not evident from the valid identity card
    or passport;
    A certificate of registration of the accompanied person;
    Documental proof that he/she is dependant (only in case of direct
    descendants over the age of 21 or direct ascendants);
    In cases laid down in n. 2 of article 3 of Act 37/2006 of 9 August
    (other family members) a document issued by the proper authority
    from the country of origin or provenance, certifying that he/she is
    dependant of the accompanied person, or proving that there are
    serious health reasons requiring imperatively the personal
    assistance by the accompanied person.

    Family members of third country nationals

    Portuguese law recognises that any national who holds a valid residence
    permit is entitled to family reunion with family members living abroad,
    provided that they have lived with him in another country, or that they
    are his dependants, or that they are living with him, whether the bonds
    were formed prior to or subsequent to the entry of the resident into
    Portugal.

    For the purpose of family reunion, the law regards the following as

    I guess that this paragraph, kind of cover your needs quite nicely............

    So, really I cannot understand why they are playing silly buggers..............:erm:

    I suppose a quick solicitor letter, threatening European action, may just move things your way.

    Keith, sorry I'm not able to help you. I have no experience at all about immigration outside of UK and I have no contacts to ask.
    I'll look through some Euro Law and see if there is anything additional to what has already been posted.

    To be honest I was expecting it would be easy.

    Keith,
    I did some further digging for the original documentation and wording on the EU law and I believe this is the EU 'Law' / EU 'Directive' you may be looking for:-

    DIRECTIVE 2004/38/EC OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 29 April 2004
    on the right of citizens of the Union and their family members to move and reside freely within the territory of the Member States....

    Brilliant Peter just what i needed

    My consular official has said they will issue a "family tourist visa "(shengan) which means i shall have to purchase refundable singles to show a return date for the airlines and initial arrival point in the shengan area ,as well as travel insurance for the visa validity in addition i dont know yet if they will want visa application fees of around 200 euros so ive told my lawer after they arrive i want compensation for all additional expence including hers from the Portuguesse government they are just incompetent buggers
