How to apply for a Partner/Spouse Visa Under New Rules

    As for the proof of residence, since we're living in his mum's house, he doesn't have anything under his name coz his mum pays for everything. he's got his license, bank account, and work reference as his proof of residence. For me, we're getting a sim contract but other than that we cannot think of anything else to add my name to, can't open a bank account yet.

    will do, Bigmac! I've read just now in another forum that proof of correspondence is not applicable to us yet coz we're just starting to live together but providing the documents would certainly help. quite confused now ...:confused:

    If I recall correctly we had a similar debate with @UKDJ when he was doing his wife's.
    I think it was agreed that as the fiancee was new to the UK and as such in no official systems so to speak it was impossible to provide any meaningful amount of correspondence.
    Any will help non will be ok.

    with that sorted out, I guess the application will be a little less stressful. My mother-in-law is thinking of paying for priority processing, do you guys think that it will be worth it considering the delays coz of the pandemic?
    we're hoping of having a decision soon after the submission, they are concerned about me having to overstay while waiting for it.

    Once you've made the application within time, while you wait for the answer your immigration status remains the same you cannot overstay.
    The only time you can now overstay is if you don't apply in time or you get a negative answer and don't leave.
    Save your money no priority service.

    Sorry I'm a bit late to the party replying to this thread...

    @Mattecube is right, we did have worries about proving my fiancee's address when moving from Fiance(e) to first FLR(M) Visa after our marriage.
    Depending on your timescale available, one of the things we did was apply for supermarket/store LOYALTY cards (not credit accounts) - Sainsbury, Tesco, Boots Advantage etc - in my fiancée's (now wife) name but as @Mattecube says, I don't think it would be a dealbreaker on their application!

    did your wife change her surname when you applied for a spousal visa? I'm thinking of keeping my surname just out of convenience, but what is it that I need to do if I decided on changing it?

    Hi @Amber26 -

    As you only have 6 months on a Fiance(e) Visa before you need to apply for the First FLR(M) - after getting married - there is not really enough time to arrange everything necessary for a change of name. Whether you choose to do it at the time of the second FLR(M) application, after 2.5 years, is personal choice. Many on here still use their unmarried/previous Surname after completing the 5-year route to ILR! A few things to consider...

    If you DO change your Surname on your passport, for example, you MUST also change the Surname on your BRP to match it 'within a reasonable time'. My wife had intended to do this in 2020 to give her some form of ID in her married name but, with the Covid-19 pandemic, there are no appointments available at the Philippines Embassy in 2020 to renew passports (at least not when I looked a couple of months ago!) which has to be done in person.
    My wife's first BRP expires in October 2021 and her passport expires in February 2022, so we may not bother to do the name change until either early 2021 or when the BRP is renewed.

    Hi, y'all!
    soooo, we got married a little over a week ago (YEHEEEY!), officially a wife now.
    I forgot to ask if I'm retaining my surname in the passport/visa, does that mean that I cannot use my husband's surname for say employment details or getting a provisional license, or opening a bank account?

    it will be easier to keep things on employment in your name ie National insurence number tax etc. Bank account best ask the bank you want to use as they may have dìfferant views at present my wife has everything in her name and we are at ILR once she gets British Citizenship we will change it all

    Hello have a good day to everyone.i just want yo ask some questions about the requirements for the spouse visa im here in UK my partner and i just got married 10th of july and we starting to gather the documents.we fill out already the application and i have scheduled of my biometric already one of the documents that they ask is my correspondence addressed,since i came here qith my fiancee visa so i have no billing address and we dont hvae joint account,and also we lived to my husband parents,my question is what is possible documents/correspondence addressed we can give??hope everyone would hepl me.thank you

    Usually, 'correspondence address' means where you live NOW - unless you are planning to move before you get the result of your visa application! Or, are they asking for PROOF of your current address, such as letters addressed to you/your partner?

    Are you saying you have already submitted the online application and paid the fees if you have already got a date for your biometrics ?

    As a fiancee as you rightly say it is difficult to supply billing addresses to you.
    Are you still living with your husbands parents if so get them to do a letter confirming you live there they will have to provide evidence who they are and of their entitlement to the address.
    Supply some of your husbands proof of address also.
    Write a note that you came here on a fiancee visa( they will be aware of this) and explain that as they are aware a fiancee cannot work, finds it difficult to open a bank account and registrar on utility bills.
    The questions on the application form are for all types of applicants some who have been here longer and are at different stages of the visa journey others like you are just starting out so it is sometimes difficult to supply what they ask for they understand this.
    Don't ignore the question just briefly and truthfully outline why you can't supply the information.

    Just wondering when we should apply for the second 2 and 1/2 years of the partner Visa. We are just over one year into my misses partner residence visa so just planning ahead.
