Wrong Category in the Application

    Hi everyone, I hope you're all alright. I just have a quick question so I hope you can shed some light.

    My application is due in two weeks and I'm just waiting for the docs to arrive from the UK.

    I just found out in the application form that our solicitor did something wrong. We want to get married in the UK (as same sex couple) not just civil partner so I believe the category should be settlement-settlement-marriage and our solicitor put settlement-settlement-proposed civil partner. They also misspelled my address. Can I ask if can i just correct it myself and just countersign in the application?

    I've corresponded with our solicitor and haven't heard from them yet but I want another opinion about this.

    I tend to overthink sometimes so bear with me. Thank you.

    This is a problem when trusting someone else with your application, you are right it is the Marriage Settlement visa you are looking at if you intend marrying in the UK (whether same sex couple is different I do not know). You certainly need to correct the address, give the ECO no excuses to decline the visa.

    What is the Settlement - proposed civil partner all about?

    @OrB may be able to put you straight, he was recently successful with a same sex application.

    Unfortunately it was late when I found out about this forum where I could get free help. We've corresponded with our solicitor two months ago and we've paid them already. They actually caused us nightmare the past weeks. We wanted to apply November 9 and then they said that they're not ready so we moved it to November 16 and they're still not ready when in fact they all have our documents. Now we are booked for December 2 which is way past our original plan and they're ready to send my documents and I found out they messed up.

    I'm actually quite confident that I am right I just want another opinion about it. I believe Orb has different situation. He is married already when he applied so he went for spouse visa and has different category.

    This seems to be an unending nightmare ;(

    I think you're on the same category with @katkatmachine ,if I'm not mistaken.
    Yes, correct your application. I can't remember how many times I checked each items just to be sure we've put the correct info.
    Mine was settlement-settlement-marriage which is also called fiance visa or family of settled person visa.
    I'm not sure what the proposed civil partner means.

    You need to be certain with your category as IT CAN BE A GROUND FOR REFUSAL. I've read before one member got their application refused because of the incorrect category.

    Yes I'm on a fiance visa too and it should be settlement-settlement-marriage as we want to get marriee not jusy have civil partner. Proposed civil partner is for same sex couples only but with marriage being legal in the England for same sex couples we should be on marriage category not proposed civil partner.

    But good thing you noticed it before the submission. The agent shouldn't have messed this up.
    If you're in the wrong category, that means filling in the form again from scratch.

    Yes they messed it up. We paid them £1200 which is a bit more than the visa application itself. They've caused us so much stress already when in fact we hired them to avoid stress :(

    Why don't you make a complaint and maybe get some (if not all) of the money back? They should be helping you and not cause stress. Now you know how the application works, you can do it yourself.

    Its a bit too late to withdraw our commitment to them already. It's such a shame. If only I've found out the other forum (where I got all my knowledge about visa applications) way before we contacted a solicitor we could've done it ourself. ;( I could only hope (AND IM POSITIVE) that this will all be worth it in the end. :(

    I'm supposed to have a good night sleep tonight. :(

    i wonder if "settlement-settlement-proposed civil partner." means a 6 month visa--with 2 FLR's--the same as a settlement-marriage ( fiancee ) visa ?

    i suppose if the applicaton list the IHS fee then it isnt a 6 month visa.

    when you get your papers I would put a big note in the very front saying Please note there has been an error in entering my addreess it should read whatever whatever as per all the documentation with my address on not whichever whichever that has been submitted on the application form
    I trust this will not impede our application,Thanking you in anticipation.

    Just an update our solicitor insisted that they applied under the correct category. They said that even though we want to marry in the UK as same sex partners the Home Office said we still have to put proposed civil partnership in the category. It was a bit misleading for me but anyway I am compelled to just trust them and hope for the best :(

    Yes technically the application and the forms are the same with fiance visa on marriage category.

    What I was trying to contest is since we same sex couples are lawfully acknowledged to get married in the UK then the right thing to put in the application is MARRIAGE rather than PROPOSED CIVIL PARTNERSHIP. Although I don't really think that makes any difference. Maybe I'm just over thinking :(

    but--check if the civil partnership visa is valid for 33 months--or only 6--( like a fiancee visa.) the former will save you one FLR fee--£811. easy way to tell--is if you have to pay the IHS fee with the application. if youre granted a civil partner visa--you can then get married--IF you want to--WHEN you want to.

    It's actually a fiance visa but different sub-category so I'll be granted 6 months in the UK and have to marry or register a civil partnership within that time and then I switch to FLR(m). So it's still an expensive route. Wish it's like what you suggested :D

    Maybe they're right after all? I can understand with you overthinking because the visa fee is quite expensive and refusal will just delay all the things you both planned.
    I can relate as I was overthinking also when we were doing the application. I can't easily be pleased and kept on telling my fiance to get this and that. :lol:
