When am I allowed to apply for my wife Indefinite leave to remain, she entered the uk on spouse visa on 13 August 2016, thanks for any help.
28 days prior to her landing in the UK as the arrival start yhe 5 years and up to the expiry date on her BRP In your case 14 July onwards
The qualifying period is 5 years. So if you arrive on a spouse visa it's the day you land the 5 year click starts to tick. If as in your case the clock ticks from the 1st BRP valid date. This then ensures that the 5 years is met as like I said in an earlier post if you are waiting for a decision between visa then the 5 years would become 5+ years. E.g. my wife arrived October 2015 we applied in October 2020 even though her BRP was valid till Feb 2022 and that would be 5 years 5 months.
i did read somewhere if a person applies for ILR too soon it could be dealt with as another FLR application.
28 days prior to 5 year date of landing in UK ( spouse visa) 28 days prior to the 5 year anniversary of your first visa valid from date (fiancee visa) 28 days prior to expiry of your brp
Stamps not necessary as long as statements are on letter headed paper we did ours off the internet for all our applications (6) mother and daughter. With names on or confirmation you are account holder
hi again, is a letter from my mother in law classed as evidence that I live with her on her property? thanks
you need to have mail addressed to you or/and to you and your hubby to your mothers address as proof of were you are living, also a letter from your Mum in Law stating you have permission to live there. If she owns the property a copy of the deeds would be good If she rents then you will need to demonstrate the landlord (private) is aware and happy for you to live there. Council tenants have different rights I think
