Applying with my 1 yo daughter

    My wife and Stepson has just got their passports back...

    My Wife = Visa Granted
    My Stepson = Visa Refused

    Yes, I have been thinking of what to do next...
    One thought is for my wife to come over before her Visa expires, stay for 2/3 week then return back to the phils... until we can re-apply and get the Visa for my Stepson.
    I'm not sure if this is allowed and for how long she could stay back in the Philis without it affecting her future FLR or ILR

    Any thoughts ?

    First thought would be if your wife spends a lot of time back home the HO may argue that you and her have not lived together and this might (and i say might) put future applications at risk! You could hoerver have a planned programme of visits ie school holidays i think that would stack up.
    Who was your stepsons sponsor?

    none if that makes sense to me. how could the childs mother be his sponsor--SHE IS NOT A SETTLED PERSON. the sponsor is the stepfather-

    who does the child live with in the filis ?

    Exactly! I think there is basis to appeal if they have mid read the information.

    and what about the child's right to family life.? sounds like a very inexperienced case worker to me.

    See posts above if you are going to have to save for the next visa fee why not appeal?

    in our case--we got a signed letter from the boys father consenting to him coming to join his mother. the boy does not live with the dad--but lives with an aunt. but she is NOT his legal guardian. we even sent in bank statements showing support payments from his mother ( my wife )

    i'm wondering if the childs application was processed by a different CO to the mothers application

    what a complete train wreck.

    How old is the son and why they saying mother is sponsor as mother and son was going to join husband/stepfather.

    She'll not live with me without her son, which I fully agree with.
