Thanks for that Peter, I hoped you either knew or would know if it might be complicated.

The interesting thing about this thread is that it would appear that if I tried to apply for a Right of Abode certificate for her that I would probably be refused as she already has had a British Passport, but at the same time if I try to apply for a visa for her that should be refused on the grounds that she does not need a visa because she already has Right of Abode as a British citizen by descent.

And of course the very important point that you make about "if departure can be made" the real hurdle is convincing the airline to even let us check in without a visa :D

We also have her consular birth registration, based on that I should be able to get an actual British birth certificate for her here in the UK I would have thought?

I had thought about the emergency travel document, but don't you have to have and 'emergency' of some kind? :)

P.S. Janna is still clearly identifiable as the being the same child as her passport picture but of course not everyone will see that, what I did think was that a current Philippine passport along with her expired first baby Philippine passport and her UK expired passport with the same picture (almost) as her baby Philippine passport might be enough to convince the airline that she had Right of Abode.

The current Philippine passport would prove that the older child was the same person as the young baby and the pictures in both first passports are of the same baby, she was 6 months old when the pictures were taken.

The linked webpage doesn't mention emergencies only this:-

    I reckon you'd be OK
Although having said that, the British Embassy these days is not what it used to be.

Thanks again Peter, it isn't a recent expiry, been a couple of years, I just was not in a position to bring her here back when it was valid, I will look at the options, it would be late this year or at the start of next year that I would be thinking about it.

I was looking at the certificate of entitlement ROA and i thought if you had that in your childs passport, then you could not have a british passport as stopped doing it, i think last year or this year, has could not have both and would not need DNA test to prove paternity if when child was born and fathers name and british citizen on the birth cert before baby was 1 year old, then that would be ok and send other documents with it, like antenatal and hospital notes and photos of father and baby together, unless i am looking at the wrong things lol
