Fiancé Visa Application

    Hi all :)

    Well everything looks to be ready now, just got to pay the visa fee and send the original documents and certified copies via dhl to the philippines.

    Application online is ready to be submitted, so will do that once that's all paid.

    Hope we have good luck with the application :)

    Application may well still get refused, and I've been rather panicking over those changes that are going to be out in place in July, 16th can't remember.

    But after reading the barrister representation letter I have to say I'm feeling a little more hopeful and for complicated cases definitely worth getting their assistance.

    They have quoted text from the UKBA requirements, then written how we meet that requirement, they have quoted things like article 8 and reminded the Eco that refusal is in breach of the echr by quoting article 8.

    They have also used quotes and outcomes from various legal cases to define and prove things etc. really quite in depth... Certainly not something that I could of put together as I don't know enough about past legal cases or law.

    In all it's about 9 pages long.


    Just hope we get a successful application :) everything has been done properly and above board, and we have tried our best to fullfill the requirements as best as possible.

    The way you've described the application appears to follow the format that they (immigration advisers) all follow.

    It would also be interesting to see the points and case law quoted by your barrister if it can be done and still keep your privacy of course:like:

    If we could have a wee peek at a copy of what the beak wrote, we could kind of quote some passages to some other people in need of that info...

    Not word for word, literally, but just the jist of it..

    Hi, thanks for all of the support :)

    im just hoping it will be successful, we have had a strong case all along on everything else, just the stumbling point has always been "finances" in the family have about 6 years worth of earnings @ 20k in savings.. and they are all prepared to support and help me and my fiance and common sense would prevail and say thats sufficient to support somebody for 6 months if normally it would take 6 years to earn lol. But unforuntately doesnt seem to be "good enough" but we have done the best we can, and all we can do is try anyway.

    Application has been submitted online now, got an application ID with that from the UKBA.

    Money for the application is going to be sent door to door later today :) through a filipino service here in the UK, you put the money in their bank account, then through Philippine national bank in london they transfer it to the philippines and deliver it to the recievers door.

    got 2 folders prepared almost.. 1 containing originals and certified copies.. and 1 containing just copies of everything, identical though so they can pick and choose what exactly they want copies of lol just want to cover everything :)

    So thats going to be sent via DHL.. so hopefully as above everything is well on its way and application will be fully in before the July deadline.

    I tried to enquire about a VIP lounge service, see other thread, but I just get email send failure.. dont know if they have suspended it? its still listed online, but I guess theres only so long they could run it from its inception before so many people are using it that it no longer becomes VIP lol

    Hi,

    My mother is Filipino, and this company LIC they are also run by Filipinos

    So I guess it's a word of mouth thing lol.

    That's their website, I dont know if their contact number is current, will compare it shortly when we do the transfer.
    But the way they work is you pay the money into their Barclays account then they use Philippine national bank in London to transfer the money to the Philippines.. And for a service fee they can deliver direct to door in the Philippines or a Philippine bank account.

    Money has now been sent, will be dropped off today hopefully at her address :)

    Application is also due to be delivered via ups today :)

    Next step then is to book the visa centre appointment.
    Going to have to phone them up, their VIP appointment email address is not working

    Hmm, a bit worried...

    Is it normal for the visa to be processed in under 2 weeks?

    We got an email saying a decision has been made, then a further email saying it will be couriered back within 24-48 hours but no hint as to wha the decision was?

    It just seems too quick, 2 weeks is this Friday so it's not even 2 weeks yet.. It's their busiest time of the year, there is the Olympics and even probably a flood of people trying to beat the deadline so this does not seem normal.. Hmm

    You will find that it will be a favorable outcome on your part...

    Sometime, if they wake up in the right frame of mind, and get out of bed from the right side of it, and all documents are well in order as requested, the ECO's will feel more ameniable to grant visas...:like:

    It is the UKBA office dealing with non EEA family members that take their sweet time....:erm:

    so it's likely to of been granted?

    Really hope it has been granted it just seems too quick :(

    And in the emails there is no hint of the descision.

    We will know in 24-48 hours I guess when everything is courier returned

    I have seen applications get approved within just a couple of days, and others that have taken weeks.

    I would guess that e-mail comes from VFS. The reason no hint of outcome is simple because VFS don't know. The only people who know are UKBA and they will not inform VFS (data protection and confidentiality etc)

    These past couple of weeks it seems UKBA has been dealing with applications very fast, maybe some extra help or an extra focus etc.

    Hi all, thanks for the best wishes :) will probably find out sometime within the next 24-36 hours lol

    Really hoping that it was successfull.

    just struggling to understand why its only been just under 2 weeks, when just last week they messaged saying that its their busiest time of the year and waiting times maybe extended.. plus theres also the rush of people getting applications in before the rules change, olympics etc.

    hmm strange, will just have to hope for the best.

    only problem now is, because its so close the the olympics the air fares are sky rocket high.. was planning on a 4-6 week timeframe for processing then if successfull, i will go there for 1 month, she will have her dress made etc and then we come back.

    but presently, with the olympics air fares (and summer time, school holidays) the air fares are averaging £1000 +/-

    Hope it's a positive result for you both. My advice to everyone I've ever helped has been to make sure they " dot every i and cross every t " then do some more. If they've done that it's been successful. Sounds like you've done that especially with the additional legal help. So here's hoping!

    Yep, tried to do that, had 2 really thick folders lol and whole lot weighed 1.5kg when we sent it via UPS.

    Hopefully have done enough.

    I feel we had a strong application, problem always was though the financial side.
    Thing is, as a family, we have enough savings to the equivalent of 6 years income after tax.. and common sense should prevail thats enough to support somebody for 6 months... its a 6 figure sum!

    But because my uncle is retired, my father is self employed.. and renovates houses, so his income is only on completion.. and I am self employed and still finding customers and developing my business.. none of us are easily able to demonstrate a regular income.

    We as a family kind of support one another rather than indvidually. Which is why we have so much savings available.. but on the downside..its hard to show monthly incomes, and that was the real stumbling point which was why we felt best to involve a barrister to represent us in the best possible way.

    Income really was never a problem.. nor is supporting my fiance for 6 months, just the problem is demonstrating it in the way they want... lol which is why im hoping it was successfull, because the july 9th changes will completely change any outcome of our application as it no longer allows 3rd party sponsers.

    Yes, in my experience it's always best to do these things as soon as you are eligible because as you say changes can quickly come in that totally change the playing field. Hope it's good news!
