Fiancé Visa Application

    Hi,

    it has been over 48 hours now.. and still recieved nothing.

    Tried phoning the courier "2GO Aboitiz"

    And despite recieving an email from VFS Global saying

    "Your processed application reference number.... dispatched to you via 2GO Aboitiz on 07/03/2012"

    2GO are telling me, they have no record of it, as they stopped doing UK Visa courier services on the 1st July 2012... and they cannot find her name on their tracking system.

    Then they gave me a VFS Global number that costs 32 peso per minute.. and is not reachable from the UK.

    Thanks for the reply :)

    Got the documents now, they are now using DHL they said.

    Visa was refused.. but the grounds for refusal I do feel is unjust and rediculas.. like an excuse rather than an actual real reason.

    But they did refuse it because,

    "They want to see a church booking" which is impossible under UK law as you cant book a wedding without both parties being present.

    And

    They was not satisfied adequate accomodation exists for her.. despite sending mortgage statements for 2 properties, and mentioning the existence of 4 others making 6 properties to choose from.

    Now following it up with our barrister.

    If they refused on finances then I would of been a little more understanding.. as we struggled to prove it in the way they wanted it, and no doubt I would of found that a rediculas reason as well.

    But the reasons they have given are either not really possible to prove as UK law prohibits it.
    And with 6 available houses within the family.. i dont know how they can say " They are not satisfied adequate accomodation exists."

    I quote,
    Notice of marriage

    Before you can marry in a register office, approved premises, chapel or church (except Anglican) in England and Wales both parties must give notice of their intention to marry.

    This has to be done in person at the register office covering the district of residence.

    They also refused it as we didnt include a letter from my uncle.. which is a failure on our part.. and probably the only just reason.. the other 2 are rediculas.

    Did you get an accommodation certificate from your local authority giving an independent assessment of the proposed property to be used for accommodation?

    Nope unfortunately, didn't know they existed until you mentioned it :(

    Barrister didn't request it, and I've not really seen any mention of it elsewhere.

    Guess that's why on that front then. So that was our fault.

    Going to have to go through appeals process now.

    Don't know if I can get one now and use it as additional evidence? Reading looks like they don't accept new evidence but they will accept additional evidence, and I guess that would count as additional evidence?

    Wedding plans, no idea how to get round that, can't legally book a wedding until she is here.. And so can't mention dates as that's dependant on her arrival.. So that is a little restrictive.

    Shame new rules come in Monday, would of been quicker to add the documents and reapply lol seeming this descision was in under 2 weeks.. Whereas appeals is 4-6 months at least. Seeming looks like as of December last year appeals also cost money now :(

    Haven't got much choice now though... Appeals process is the way forward now

    Get one from your local authority. It's a certificate/letter from the authority confirming they have assessed the proposed accommodation and confirm it would be suitable to accommodate your fiancé.

    By getting that you are taking away the guesswork that you would otherwise be expecting the ECO do. You need to take away the question marks so the ECO doesn't have any doubt.

    Well.......... I just hope that the sod doesn't have the balls to ask for more money for the appeals.. :(

    Lol, I wish.. They have said the money I paid before will now become the appeal money, and then I need to pay again for the services already rendered. To the tune of £750 extra.

    Then another 750 to process the settlement visa later on.

    Hi,

    Has anybody had this before? I'm finding it really odd to say the least..

    Basically when I submitted the application I made up 2 folders.. Both folders were identical in every aspect... Only difference was one was 100% copies and the other was originals and certified copies.. But aside from this identical in every way, included the same documents etc.

    Now my fiance looked through the returned originals folder today because I said she could keep the photos when finished as they was enlarged A4 sized digital prints.

    Except they appear to be missing, nothing else seems to be missing but why would they keep not only the copies.. But the originals as well?

    Not only that it seems like just about the strangest thing for them to take :s a couple of photos of us both together...

    Latest is waiting to get the accommodation certificate.. It's been 1 week nearly and nobody has called us back yet and whenever we chase it they just say somebody will phone in a day or 2.. That was almost a week ago lol.

    Barrister says we can get something from estate agent also? That will serve same purpose if council doesn't come through..

    Hi all,

    I have tried for a week to get an accomodation report from the local council.. they just pass me around, say somebody will phone back.. but never does.

    Estate agents my barrister said can do "property inspection reports" but.. none locally seem to know what this is.. or anything helpfull that is of use.

    so in the end, after wasting 1 week, I looked for a surveyor to do it.

    and came accross this guy, http://www.propertyinspectionreport.co.uk/

    He said all he does is property inspection reports for the purposes of visas, its all he does, visa related ones.

    Quote taken from his website,

    he seems familiar and well versed with their excuses for refusal, and how to meet the requirements.

    with us, phoned him, on a saturday! and a few hours later he turned up, and he did the report the same evening and sent us a draft of it.

    Really pleased and hope it meets their needs.. as it comes from a chartered surveyor

    i had the same problem like u had.received same email only to find out they refused my application on the basis that we didn't prove there's enough accommodation for me and that his mother didn't write a consent letter. we didn't hire anyone to help us with the application but after they denied my application i told my then fiance to hire an expert for that. so we filed an appeal for that. we enclosed the tenancy agreement, took pictures of the house,all the rooms and stated all the room sizes. we also said there who occupied each rooms. and we managed to get a letter from the council that my stay won't cause an overcrowding. we didn't provide any property inspection report, his mom also provide a letter. sent those documents to the tribunal in UK. and i thought it will take 6 months of waiting for the decision cause they sent me a letter saying that they will get in touch after july 23. but then to my surprised, sometime in may they emailed me saying that i need to send my passport to the british embassy for my visa because their previous decision has been overturned. now, im in UK preparing all the docs needed for my application for FLR.

    about the marriage thing, they really need it to prove that you really have an intention to marry in UK within 6 months once you got your visa. my husband now made a booking in their local registry called provisional booking of our intention of getting married last january. since we were denied of my visa sometime in january he had to rebook another schedule for our wedding and made it in june. but the registry said i should be there 3 weeks before the said date. got my visa may 24 and since i need to file my resignation from work, made some shopping and send off parties, i flew last june 20. and we had to move our wedding again in july.

    Thanks for the reply, I think we are coming up to around month 4 also now because they said we will hear from the courts again after January 6th.

    No sign of decision being overturned yet.. Just staying hopeful, glad you had yours overturned ok :) and everything is ok.

    Thanks for the reply and apologies for the delay in my response, been busy working on a plan b should it require another application in the future.. Had to try setting up 2 further businesses lol which is keeping me busy.

    Nearly November now and still not heard anything back since.. The worst part is not knowing.

    From what I gather the embassy in Manila is supposed to use the 6 months to prepare their court documents if they aren't going to overturn it, but because they can and do overturn it any time right up until the last minute the suspense is killing as to whether or not you are waiting in vain for court or if you should be preparing for the visa to be granted.

    So annoying, they have a descision after 2 weeks or so, yet it takes the months and months to decide if they will overturn or not.

    Am I likely to hear an overturned decision at this point or should I fear the worse which is that it's going to court.

    I wish they would overturn it, their original reason for declining was no adequate proof of accommodation, which we got a surveyor who soecialises in immigration property inspection reports.. So that was hopefully fulfilled.. And they wanted a letter from my parents and uncle further confirming we was allowed use of the funds for maintenance.. Again we provided that.

    But knowing anything they have come up with new reasons.

    Would be ideal if they granted it in next few weeks, lots of flight offers on at the moment with Singapore airlines throughout October - November before it goes up again before Christmas.. And also my mum is going soon again home to visit my uncle there so she could come back together saving an extra air fare lol

    I have read your story and I wish you good luck in your appeal. It seems that if you do have to reapply then you may not meet the new income requirements so it must be a very worrying time for you both.

    Don't know if this is any help,...but when i was in your situation 7 years ago I phoned 'Gretna Green' and asked for a date to be married there within the 6 months of my Fiancee's proposed arrival. They gave me a date and sent me an official copy with the detailed billing of the ceremony. I sent this over to my Fiancee to take along with the other paperwork. She got her visa ,...but we never really wanted to get married at Gretna so just cancelled when she arrived and got married elsewhere. Don't know if you can still do that yet ??
