Fiancé Visa Application

    Hi Jonny, I think that suggestion is too late to RB2004 as he is already quite deep into the appeal process.

    But, that is a darn good idea. Thanks for that contribution.
    Whether it would make any influence or not can't be known but anything like that has just got to worth the input.

    Hi, apologies for the delay in responding, due to them not accepting 3rd party sponsorship I would not meet the new requirements, which is why I have had to work on a plan B, in the event it is declined again in the appeal, but it might mean another 12-18 month delay again by the time I have a tax return I can send after next summer when if everythings ok I should have the required income to demonstrate... wont be able to show anything before the end of next summer should a new application need to be made.

    Which is why like you have said I am worried about it being declined.

    But the really annying thing about it is.. as far as we are concerned, as far as the barrister is concerned we meet the requirements... we have multiple properties available for our use, we have demonstrated an income that is more than sufficient to support somebody for 6 months...well unless the ECO thinks we are likely to spend £20,000 a month in expenses.. the amount we demonstrated would be equivalent of 6 years income, after tax in an amount that even exceeds the figure they have set in the new rules for yearly earnings... that money is sat in the bank as savings.

    Just occurs to me it is the ECO being an idiot, more than anything else.

    But what is even more stupid about the rules.. which I have found, thier basis for setting these financial barriers is that they dont want you to be using public funds to support the partner when they arrive in the country.

    HOWEVER, they deem it perfectly acceptable if you are living wholy on benefits and not working.. and demonstrate those benefits as your income... so under the old rules, if you had sufficient benefits left over at the end of the week of around £150? then that was sufficient evidence for them to be satisfied you can support the partnet and grant a visa... never mind the fact that that income was purely handouts.

    lol, but if they are that worried about me claiming benefits to support my fiance.. wonder how long id get away with it if I turned around and said to them, well then I will stop paying my national insurance... THEN i wont be entitled to any benefits will I! so how can I use benefits to support her if im not even entitled to them. lol

    In that persons case it was a visitor visa but they said,

    "So far I have written to my MP and asked him to contact Stephen Lillie regarding this matter. I have also contacted the Embassy via email (3 different address), facebook and twitter (they have already replied via twitter). I will phone them in the morning, but hopefully i will have a reply from one of my emails by then...

    I have also dropped an email to VFS who is the company who checks over the visas....

    Also spoken to the Deputy Manager for VFS Global Operations in the Philippines who will forward my details onto the Visa Management team.

    Not had a reply from the "Entry Clearance Manager" yet - I am pushing this every way I can. God knows how we let some many people into this country if it's this difficult to get a tourist visa!"

    Then they got an email back saying,

    Please be informed that the decision to refuse Ms Xxxxxx’s visa application for entry clearance has been reviewed by an Entry Clearance Manager and has been overturned.. Kindly ask the applicant to submit her passport so that an Entry Clearance Officer can consider her application further.
    .
    She must send her passport, via courier, to the Embassy within 2 weeks from the date of this letter to the following address:

    So just wondering if it would help if I took similar action? Worked for them.. or would this interfere with the appeals process and likely make things worse?
