gf visa refused, but evidence not looked at correctly

    hi I've been going through a visa application for my Filipino gf , using a lawyer to help us.
    The entry clearance officer declined her a visa saying that she has not got a job to go back to despite us putting in evidence to support that she is in full time employment , permission for a holiday etc etc. my gf also received the bundle of documents back and there is documents missing relating to her work, our lawyer is trying to do what she calls a entry clearance officer review, but the problem is no one is responding to her emails in the embassy in manila, we have been waiting for at least 6 weeks but no response.
    has anyone else had this?

    Presumably this is a visit visa?

    I always recommend a list of contents. There is no guarantee that they will read that either but with one, sited as the first page of an application, it spells out the content of the application that only the myopic would miss.

    Also photocopies of all docs submitted is useful.

    I recall someone getting refused a spouse visa under similar circumstances. The response from the ECO was that there was no evidence submitted, for certain sections of the application, when it clearly had been. The sponsor and applicant managed, eventually, to get the refusal overturned.

    yes its a visiting visa,
    yeah to be honest there was a list of the contents, the lawyer prepared the bundle of documents and I added my documents and even put the documents in clear plastic sleeves with a piece of paper at the front to say what was inside it,
    the problem is getting them to look at it again for them to reconsider which is probably a mistake, my lawyer has been trying to contact them but each time she emails she just gets an automated response for the last 6 weeks

    Its frustrating especially if you have the old fashioned notion that they are our public servants there to facilitate our lives the reality is clearly somewhat different and if your lawyer cant get a responce to a legitimate query the more so.

    probably easier--and quicker just to submit a fresh application. i presume your g/f has stated shes coming over just to visit family relatives. not her boyfriend. nudge nudge.

    well the application cost me £600, and now I spent another £300 for her to do this eco review which she has said they should give us a answer but problem is the embassy not answering her request.
    does that make a difference, the lawyer has written as she is visiting me her boyfriend

    yeah its annoying ive been trying to sort this out since January and just seem to be going round in circles

    £600 for a visit visa--how ? the visa fee is about £90.

    UKVI are worried asian girlfriends visiting UK boyfriends might forget to go home.

    sorry yeah it is about £90 the lawyer fee is 600, if I get the lawyer to redo it all I guess they charge me another 600, but she has said to do this way as she thinks the eco has just made a mistake in not looking at the evidence properly

    but if we say she seeing family wouldn't they ask who she visiting, where and how they related? we put supporting letters from me , my parents ,my boss, her friends her boss and from my gf

    for what its worth--lots on here have had visit visas refused. apart from legal fees--its a cheap visa--best just to get your g/f to apply herself---give strong compelling proof of need to return---job--home--bank account--family ties. thers no hard and fast rule. my g/f got refused on a technicality--using a local visa agent--then applied again herself--and got in. she was visiting her sister--who lives here.

    yeah this is first time ive done anything like this, that's why I got advised to use a lawyer and to be fair the lawyer has made sure all those things are in the bundle of documents. what piss me off is that its all this hassle if I want to see my gf here for a week or 6 months

    also you would think they would reply to an email, I know we are not the only ones but a reply to say yes we will look into this or no we wont, is better than hearing nothing

    I'm not sure it's worth using a lawyer for a visit visa really. In fact I'm not really sure lawyers are the est people to help with any visa.

    They may know the law but do they really know the ins and outs of what is needed in a visa application?

    Plus, 600 quid fee on a 90 quid visa? You could have had 6 more attempts for that and still had 60 quid change.

    As others have said, tourist visas for Filipino women are difficult to get. A travel agent might be a better option?

    Am I correct in saying that visit visa refusals cannot be challenged?

    they are suppose to be imigration lawyers,
    on the bottom of the refusal letter it says " no appeal" but the lawyer said we can do an eco review, which they can choose not to look at our case, but the lawyer said she has not had this before,so she said as it looks like they have not looked at evidence properly, the eco review is the best option

    Sounds like re consideration as used on a settlement visa.

    Yes. Not looked at the evidence properly. Too busy partying. :D

    As Bigmac said, it might be better to make another application. But I would not lie, particularly as one application has gone in already.

    Now you know the routine, for £80 you could do it yourselves?

    yeah and i guess we have already got the documents in place its just the dates will be different, i just thought using a lawyer would make the process easier as they know the process , i just feel frustrated that that they wont respond to us, the lawyer has ask my gf to take some documents personally to the embassy, these are the ones asking for a review
