gf visa refused, but evidence not looked at correctly

    Its a bit of a catch 22, do you keep throwing money into the bottomless pit or do you cut your losses and use the visa money/Lawyer money to visit your loved one in the Philippines.

    If the case officer did mess up it is unlikely he will admit to it.

    I know how frustrated you must feel steven, we had two visit visas turned down, its no fun at all.

    i just feel that if they made a mistake then it should be put right , same as if i make a mistake at work.
    it just seems like its one big con, ive tried to do the right thing ive used a lawyer have been honest etc etc.
    i never imagined it would take this long and be so stressfull for basicly to begin with would have been a two week holiday for her

    Having said that (and of course no real consolation to you) this category of visa does have a low success rate.

    bigmac is that down to refusals on a visting visa? thats a longtime to be waiting, i met my gf in 2013 and we have been trying to sort this out for around a 9 months now

    My wife had her first visit visa refused in January, But we reapplied and it was granted in March. So don't loose heart learn from it and make it work for you. Use the info they gave for refusal and make the changes needed.
    The visit visa is simple to fill in so don't think you need a lawyer its only £90.
    The main issue we had is to prove reason to return. So lay it on thick that she needs to return for family and work. And all the paperwork you can use to prove her work and family commitments. But don't lie.

    i got divorced
    she got an annullment
    i sold my house to free up capital to meet savings requirement.
    had all gone to plan she could have been here a year ago--but life got in the way

    a wife applying for a visit visa is a red flag to a case officer-----who will think the applicant is trying to get in and join her partner without paying the full 5 year settlement visa fees----£thousands instead of £90.

    frankly i am surprised you got a visit visa at all.

    im going to give them a bit of time, mf gf handed in this request for a eco review from our lawyer this morning, so will see how that goes.

    Bigmac why are you surprised about a visit visa? all she is doing visiting me here in uk and then going back home, we don't intend to get married at this moment in time.

    The reason for Bigmac's surprise is that these are diffcult to obtain and the ECO tend to think that a pinay visiting a boyfriend, fiance or husband is likely to overstay.

    However, they are not impossible to obtain and the trick is, as Luke says, to persevere and give them no reason to assume the applicant might overstay.

    I just went with what the lawyer recommended, we did include documents to do with returning back for work, family she has there and letters from friends etc.. which is why the lawyer was surprised it didn't go through as we provided enough evidence to prove she needs to return back to the Philippines, this is why the lawyer recommended the next step was to try and get the embassy do an eco review as we feel that someone simply has not looked at the evidence properly.

    Seriously, why are you wasting time and money on lawyers with this.

    Just learn from this one and apply again.

    My wife's friend tried to get a visa for her father. They failed first time. Second time they were successful.

    Lawyers really aren't the best route with this, but if you are prepared to chuck money at them they ain't gonna turn it down.

    obviously I don't want to chuck money away if I don't have to ive already paid them to do the work so they can carry on, im not going to tell them to stop halfway through, once ive been told by the eco that they wont review then I can reapply, problem is they wont even tell us whats going on, not responding to emails etc

    If theb lawyers still working from your original payment fine otherwise you might be best to put it down to a learning curve and to be honest you would be more likely to spend time with her by going to her

    yeah they are doing that, but like I keep saying there's no response from the eco as to if they will reconsider our case which is frustrating as t least if they say no I can move on and try again, or I would like you say go there to see her
