How to apply for a Partner/Spouse Visa Under New Rules

    Here the 5 year settlement is a nice fat cash cow for the treasury. Fees have just leapt up by 25%. Our first FLR will cost me over £1800 for same day service..plus the cost of getting to Croydon ukvi office.

    Hi quick question re spouse visa application i have to provide 2 ID's right?. I already renewed my passport using husband name. Do i also need to update my govt ID using my husband last name? Is it required? Thank you po.

    No need to change your Government ID for the application, you will find yourself juggling with two names whilst going through the visa process. On the application form it does ask for other names you are known by so no problem.

    The financial evidence for self-employed people states:

    Additionally One of the following documents must also be submitted:

    - Organisation’s latest annual audited accounts with the name of the accountant clearly shown. The accountant must be a member of an accredited accounting body (CIMA, CIPFA, ACCA, ACA, etc).

    - Certificate of VAT registration and latest VAT return confirming VAT registration number if turnover in excess of £73,000.

    - Evidence to show appropriate planning permission or local planning authority consent is held to operate the type/class of business at the trading address (where this is a local authority requirement).

    - Franchise agreement signed by both parties. This is a mandatory document for any organisation that is a franchise.



    I am self-employed and I have have asked my accountant for a set of audited accounts ( the only one of the above that remotely applies to me) and he says
    'In general terms ,under Self Assessment ,the self employed pages of the tax return contain the HMRC required standard accounting information & accounts are no longer submitted to HMRC(except by limited companies)'

    I wonder if UKBA would be happy with a copy of the Internet Tax Return accompanied by the HMRC Receipt?

    Does anyone have any experience of this?

    This whole process is such a slog :(

    Yeah - the whole point is that I cannot provide any of the 4 documents demanded :(

    @Maharg will be able to give you some sound advise, he recently obtained his second FLR as self employed.

    Interestingly, when I checked the latest version of the UKBA visa rules they have changed the clause to read '(h) One of the following documents must also be submitted: (i) (aa) If the business is required to produce annual audited accounts, such accounts for the last full financial year; or Appendix FM 1.7: Financial Requirement August 2015 62 (bb) If the business is not required to produce annual audited accounts, unaudited accounts for the last full financial year and an accountant’s certificate of confirmation, from an accountant who is a member of a UK Recognised Supervisory Body (as defined in the Companies Act 2006);'

    Subtle change but a step in the right direction towards joining the human race - I am sure my accountant will be able to provide this (for a juicy fee) - this whole process is making me sick :sick:

    My accounts aren't audited. I submitted my accounts spreadsheets, invoices, business bank statements, tax returns, accountant's statement of annual earnings, my self employment registration from the HMRC website, my tax statements from HMRC and a letter from my accountant stating my earnings.

    The accountant letter also stated that my accounts aren't audited and gave the reason why not (which I can't remember off hand, but he did tell me they don't need to be audited).

    I don't think I sent in "annual audited accounts" back in 2008.

    How long usually the result of the visa is it really 3 months?Or did any one here got it earlier than that?is there anyone here got negative result? We're little worried it's 5 weeks now since I submit mine. The burden of waiting

    It can take up to three months, only 10 days for those who opted for the premium service.

    Yes - I have asked my accountant to do a similar letter - only 100 quid - I'm definitely in the wrong business!

    Hi everyone, were already starting to prepare the documents we need for the Spouse visa and I have a few questions.

    Hope you can help us.

    1. In the online application, do I put settlement - husband? Marriage? Civil partnership? I'm not really sure what option to put. We are married (not civil partnership) here in the uk embassy at Manila (same sex marriage so it is not recognized in Philippines but we got marriage certificate registered in a UK land)

    2. Our marriage certificate is released from the British embassy at Manila and we will not get a marriage license in Philippines since it is same sex marriage. Is it fine to submit the marriage certificate we have even though it's not certified by NSO?

    3. My husband is preparing the documents and we need to provide docs for his mortgage. We have the bank statement and I read somewhere that we need to get something in the land registry? What specific document we need to get in the land registry website?

    1. I would put Settlement - Husband, you are now the husband in the UKs eyes after all.

    2. Just submit the marriage certificate given by the British Embassy, you are applying for a British visa so the fact that the Philippine Government does not recognize your marriage should not make any difference.

    3. Your husband will have been given land registry documents when he went through the process of securing his mortgage.

    Thanks Timmers. Which land registry document do we specifically need? Is it the same title deeds?

    My husband is trying to search through all his mortgage documents but if he didn't find it, we might as well request the document in the land registry website. But there are a few list of documents in there, were not sure which one we really need.
