I applied for spouse visa with one dependent child last yr. we submitted our documents october and we got the succesful result last week of december. I would say our application was straightforward.

    Hi,

    A question about dependent child.

When is a child a dependent? I have 2 children and am listed on the birth certificate for botj. One has a Right of Abode , the other i will request another ROA.

Do they need to be listed on the spouse visa as dependent?

I think my question is what is a dependent child :)

    Thx

I may be wrong but I believe a ROI does not trump a Passport and your children would need Visas to enter and settle in the UK. A Passport is cheaper in itself, takes about the same length of time to issue and the same (or similar) documentary requirements as a ROI and saves a lot of hassle.

If your children are to travel on their Philippine Passports, then they should be listed as dependents (and the appropriate extra Visa fees paid) and your minimum annual earnings requirement increases by £4,800.

    Hi thanks for the feedback.

I am just trying to double check before I apply! Its so confusing!

The Right of Abode give the holder the right to stay in the UK without a visa. When we originally applied for a tourist visa for the first child, Immigration told me that they are not eligible for any visa as they are British by descent. The only option was ROA or passport. But the passport was taking a year plus and the ROA only took 15 days at that time!

I have been advised that they need to be listed as dependants on the spouse visa but don't need to pay extra visa fees as they will be covered by the ROA.

Will double also double check elsewhere and update here!

I would strongly suggest that you apply for your children's British Passports now and whilst you're working towards and waiting for your wife's visa. Issuance is now more rapid, provided that all the paperwork is complete and in order and you should receive them within 3 to 4 months - that's probably quicker than the Visa.

The Passport Office requires applications for new (first time) Passports to be made from within the country of birth.

Thanks for the info. Is there any Sicky posts on current time frames for the different type of visas/certs.

I was working on the following basis:

Right of Abode / cert of entitlement : 1 month

    UK Passport:4 months ? To 12 months

    Spouse Visa: 2-3 months.

So that's why I was going for ROA and spouse as it's the quickest turnaround.

Will see if this forum has any more feedback on ROA turnaround.

    Thanks again,

    RJD

Two to three months for your wife's visa? I suggest it will two to three times longer than that - and that's assuming the application is simple and therefore easy to determine; several members have been waiting for decisions for more than one hundred working days. But your's may well not be since you live in the Philippines and are unable to prove that you are employmed in the UK and back that up with at least 6 months' pay-slips, contract of employment and employer's letter. Or the relevant amount of savings deposited in an immediate-access bank account and that's been held for at least six months.

Thank you for the continued updates. Really appreciate it!

Slightly strange situation but I am working in the Phils but get paid via the UK :) I have all the employer proof / salary slips etc - so covered there.

As mentioned it would be really cool to see an overview of the current timelines for each application.I will give you feedback on how the process goes.

I was told to expect "up to 30 working days" for a Priority service last week by UK Visa. Obviously that has gone out of the window now they have lost our biometrics.

This confuses me. If my children are British by descent with either ROA or UK passport do I need to earn 18.6K or the 18600+3800+2400?

My case is not longer a "normal" application. We have to redo the biometrics. My fiance is in the Cayman islands and they have biometric days at best twice a month, the next one is Aug 16th. I believe that without this issue we would have had our visa within the 30 day time frame
