exemption from financal requirements on visa

    Hopefully they could do a bit better on the flight cost. One way is a little cheaper, too.

    Mrs Ash had a one way ticket. We saved a couple of hundred quids.

    I always thougt you had to have a return ticket, even if you are not using it, thanks for the replies as always learning more on this site.

    Often the single is more than half the return. But if there is no need for a return ticket, why pay the extra....

    Firstly, Disability Living Allowance (DLA) is being replaced by Personal Independence Payment (PIP) and, as a new applicant, you will have to apply for PIP (not DLA). The good news is that PIP also exempts you from the usual income requirements but the bad news is that getting PIP is more difficult as they have toughened up on the eligibility rules as well as abandoning the lower rate care component altogether.

    If you do receive PIP, you have to satisfy ADEQUATE MAINTENANCE requirements instead. In effect, that means your income must be at or above Income Support level for a married couple after paying housing costs (rent/mortgage/Council Tax) Luckily, you can also use income-related benefits to support the visa application under the ADEQUATE MAINTENANCE provisions (you cannot do so under the usual income rules)

    For a married couple (without children) the Income Support level is £114.85/week. So, if your income is above this (after paying housing costs) your wife could apply for her visa. If your income is below the Income Support level all is not lost, providing you have sufficient savings.

    Its doable. A friend of my wife got her 2 children across ( sponsors step kids).

    It can depend on the age of the child and whether the biological father grants permission. If you overcome that hurdle with the Philippine authorities, the next hurdle is meeting the higher income requirements because you would then have to meet the Income Support level of a family with one child.

    my wife was told if get a wk60 (i think it is but will ask her tomorrow and change if wrong) then has our son only 5 she not need fathers permission as she the legal guardian.

    Howerd, can i ask you what is classed has income related benefits, thanks for any help, has i am having trouble how to work out how much a week i am on has ESA is not allowed i think to count towards it.

    Income related benefits include Income Support, Pension Credit, Housing Benefit, Council Tax Benefit, Job Seekers Allowance (income based element) and Employment Support Allowance (income based element).

    I thought on the form ESA is not counted towards the income or am i looking at the wrong form, thanks for that Howerd.

    I think (maybe) that ESA cannot be used as a source of income under the normal income rules but ESA (both income-related and contributory) can definitely be used under the ADEQUATE MAINTENANCE rules...

    Yea u will be excempted if u apply for spouse visa as long as u have all the evidence like intitlement letter comfirming your on receipt of DLA..
    I remember when i was applying before i send them even letter from job seekers allowance..housing benefits of my husband..

    Hi. Atlast i found the right thread..i will be applying under adequate maintenance..
    Are Child benefit, Child tax credit,and state pension can be included as income related benefits? My partner is on PIP about £304 monthly.. What is the income support level for a couple with one dependent? Aside PIP, he receives other benefits;
    State pension= 140 quid per week
    Child benefit= 21 quid per week
    Child tax credit=64 quid per week
    Housing benefit=130 weekly
    Will going to apply for fiance visa early nxt year.. Will these suffice the adequate maintenance requirements?
