exemption from financal requirements on visa

    He is deemed to have enough to support you if he has £111.00 left per week left over after his rent is paid, from what you posted on your other thread he has enough. PIP is not a great deal of money, see the attached link;

    You'll be fine young lady, you do not have to provide very much financial documentation compared with the regular way of meeting the financial requirement;


    12. Where a person is in receipt of Carer's Allowance, Disability Living Allowance, Severe Disablement Allowance, Industrial Injuries Disablement Benefit, Attendance Allowance or Personal Independence Payment, or Armed Forces Independence Payment or Guaranteed Income Payment under the Armed Forces Compensation Scheme or Constant Attendance Allowance, Mobility Supplement or War Disablement Pension under the War Pensions Scheme, all the following must be provided:


    (a) Official documentation from the Department for Work and Pensions or Veterans Agency confirming the current entitlement and the amount currently received.

    (b) At least one personal bank statement in the 12-month period prior to the date of application, showing payment of the benefit or allowance to which the person is currently entitled into their account.

    3.6.4. The applicant will not need to meet the minimum income threshold. Instead, the applicant is required to demonstrate that they will be adequately maintained without recourse to public funds. The relevant guidance is set out in IDI Chapter 8 section 1.7a

    Lovely! Can this be found on the link you posted from other thread? Whats the best approach on how to demonstrate that i will be adequately maintained without recourse to public funds?

    Yes, I copied the passage from the document I downloaded to the site yesterday, all the information you need is there, the reason I'm not more specific is because I did not go this route myself but I can see that it should be quite straight forward for you, ask your sponsor in the UK to help you, that's the best way :)

    It only says you need to be on pip and not about how much you get,just show your pip award letter and how much you get and also it needs to show on your bank statement that you are receiving it,that was all i showed to prove i got it.

    I read through and indeed the passage I posted in # 63 shows that it is quite straight forward to evidence that you are receiving PIP, the UKVI ask for very little, I like it :)

    Assessing adequate maintenance
    3.1. How to assess adequate maintenance
    The Upper Tribunal case of Ahmed [benefits; proof of receipt; evidence] Bangladesh [2013] UKUT 84 [IAC] directed the Home Office to evidence financial figures in all decision letters in which refusal was based on inadequate maintenance. Therefore, decision makers considering an application for entry clearance, leave to remain, further leave to remain or indefinite leave to remain which has to meet a requirement for adequate maintenance must set out the financial position of the applicant/sponsor in all cases that fall for refusal using the following formula:

    A – B ≥ C

    A minus B is greater than or equal to C.
    Where:
    A is the net income (after deduction of income tax and National Insurance contributions);
    B is housing costs (i.e. what needs to be spent on accommodation); and
    C is the amount of Income Support an equivalent British family of that size can receive. The decision maker must take the following steps to assess the adequacy of the funds available:
    a) Establish the sponsor’s and/or applicant’s (if they are in the UK with permission to work) current total weekly net income (A).
     If the net income varies, calculate a weekly mean average.

     Include all net income currently received, including benefits currently received to which the person is entitled, but exclude third party support.

     An entry clearance applicant may say they will be entitled to claim public funds in their own right in the UK, e.g. under reciprocal arrangements between the UK and their home country, and ask for this to be included in their net income. However, any potential future entitlement to benefits after the applicant arrives in the UK does not count towards net income when assessing adequate maintenance.

     Where there are permitted cash savings, include a weekly equivalent figure (see 3.2).

    b) Establish the sponsor’s current weekly housing costs from the evidence provided (B). c) Deduct the weekly housing costs from the weekly net income (A).
    d) Calculate how much a British family unit (of equivalent size to the sponsor and their family unit) would receive if they were in receipt of Income Support (C).

     Decision makers must always use the correct rates which apply at the date of their decision. Case studies in this guidance show the method for setting out a calculation and do not necessarily represent current rates.
    e) Compare the weekly net income after deduction of weekly housing costs with the equivalent level of Income Support using the following formula:
    A – B ≥ C
    A minus B is greater than or equal to C
    Personal debt, including loans and credit card debt, should not be taken into account in this assessment. Only the weekly housing costs are deducted from the weekly net income. Where the weekly equivalent of income or housing costs is calculated to part of a penny, decision makers should always round this figure down

    4. Income
    4.1. Permitted income sources
    The following sources of income of the applicant (in respect of employment or selfemployment, only if they are in the UK with permission to work) or (as appropriate) their
    partner, parent, parent’s partner or other sponsor can be counted where an application under Appendix FM has to meet the adequate maintenance requirement:
     Income from salaried or non-salaried employment.
     Non-employment income, e.g. property rental or dividends from shares.
     Income from Working Tax Credit, Child Tax Credit, Child Benefit, income-related benefits, contributory benefits and benefits/pensions payable to Armed Forces veterans and their partner.
     Cash savings held for at least 6 months prior to the date of application.
     State (UK or foreign) or private pension.
     Income from self-employment and income as a director of a specified limited company
    in the UK.
    4.2. Income sources not permitted
    The following sources of income cannot be counted where an application under Appendix FM has to meet the adequate maintenance requirement:
     Third party support.
    Financial support from a third party support cannot be counted, except where permitted under paragraph 1(b) of Appendix FM-SE (e.g. a gift of cash savings which have now been held by the applicant/sponsor for at least 6 months by the date of application and are under their control; alimony or maintenance payments from a former partner; or an academic maintenance grant or stipend). Promises of support from a third party cannot be counted as they are vulnerable to a change in that person’s circumstances or in the applicant’s and/or sponsor’s relationship with them.
    4.3. Combining income sources
    Under paragraph 12B of Appendix FM-SE, all forms of permitted income (including from selfemployment income) and cash savings can be combined to meet the adequate maintenance requirement, providing that the decision maker is content they are lawfully derived and the specified evidence rules are met where those apply.

    Hi guys,
    Need clarification with this paragraph from appendix FM1.

    Does it mean that i only need to submit atleast ONE bankstatement? and not 12 bankstatements for 12 months?

    Yes. You can send the latest bank statement showing payment of the amount of benefit or allowance..

    I think it means you only need your last bank statement showing your pip/dla allowance in your bank,instead of waiting for 12 months bank statements with pip/dla,if only send 1 bank statement might say not shown enough evidence.

    Yes i sent 12 bank statements and only last 3 statements showed my pip as only just got the pip award,thats how i got my wife and stepson here.

    @deanobeano ..hope u don't mind me asking if you got the complete list of the requirements that you submit in home office? Where to apply the visa? Are the documents must going to submit in a shiffield by post?

    For thr exemption list,it was just the bank statements and the dwp pip award letter i sent my wife,i have not done the next one yet as not needed til may next year.
